Awareness Workshop on New Taxes and Levies was successfully conducted at the NCASL Central Branch Auditorium

On 24th March 2026, a meeting was convened by the Secretary of the Ministry of Housing, Construction and Water Supply following repeated concerns raised by the Chairman of the National Construction Association of Sri Lanka (NCASL) regarding several prevailing issues in the construction industry. The meeting was attended by relevant officials from the Ministry, the Department of Buildings, CIDA, and the Chief Secretariats of each Province. The Honorary Chairman, honorary 1st Vice Chairman, several honorary Branch Chairmen, and the Executive Officer of NCASL also participated in the meeting.* - _Treatment of Social Security Contribution Levy (SSCL) in Tender Pricing/Engineering Estimates_ The application of the Social Security Contribution Levy (SSCL) in tender pricing was discussed in detail. The Secretary of the Ministry of Housing, Construction and Water Supply highlighted the importance of reimbursing taxes and levies imposed on public construction works to the contractor. However, since the Department of Buildings’ Schedule of Rates already incorporates SSCL, and in line with the Cabinet decision dated 12th January 2026 it has been directed all government institutions to adopt the Department of Buildings’ Schedule of Rates for engineering estimates, it was agreed that Provincial Councils may proceed accordingly and include SSCL within their respective Schedules of Rates. - _Implementation of a Common Price Norms_ The Chairman of NCASL highlighted the need for establishing a uniform, updated set of norms for unit rated across the country taking into account adopted latest construction technologies and methodologies. It was further noted that existing rate norms used by various government institutions are outdated and inconsistent, with different provinces applying varying norms for similar work, thereby creating inconsistencies in procurement processes. Accordingly, it was decided to initiate the development of a standardized, island wide set of norms by identifying outdated rates/norms and updating them through a structured review process. NCASL was invited to submit proposals highlighting areas requiring revisions. - _Application of Overhead and Profit Factors_ The Chairman of NCASL emphasized that, considering current tax policies which have increased the tax burden on contractors’ profits, the existing rate build-ups should be revised. He proposed the following structure: Rate = Cost + 2.5% (SSCL) + 20% (Profit and Head Office Overhead) + Separate preliminary Bill as indicated in CIDA/ID/04, including relevant items for the particular project This matter was taken up for further consideration. - _Other Matters_ The Chairman of NCASL also raised concerns regarding certain practices observed in government institutions, particularly within Provincial Councils, including: - Negotiating prices with the lowest bidder for discounts in order to award the tender, - Not permitting price escalation for contracts exceeding three months. - Importance of applying price escalation for contracts less than three months considering prevailing rapid changes in fuel and other construction materials The Secretary of the Ministry and other officials clarified that such practices are inconsistent with established procurement guidelines. They emphasized that adherence to existing regulations and procedures would prevent these issues and improve the efficiency and transparency of the public procurement process. The importance of complying with procurement guidelines and manuals was strongly reiterated.

ජාතික ඉදිකිරීම් සංගමයේ (NCASL) ගරු සභාපතිතුමා විසින් පසුගිය කාලයේ ඉදිරිපත් කළ ඉදිකිරීම් කර්මාන්තයේ පවතින ගැටලු සම්බන්ධයෙන් සාකච්ඡා කිරීම සඳහා, නිවාස, ඉදිකිරීම් හා ජල සැපයුම් අමාත්‍යාංශයේ ලේකම්තුමා විසින් 2026.03.24 දින රැස්වීමක් කැඳවනු ලැබීය. එම රැස්වීමට එම අමාත්‍යාංශයේ, ගොඩනැගිලි දෙපාර්තමේන්තුවේ, CIDA සහ පළාත් ප්‍රධාන ලේකම් කාර්යාල නියෝජිතයින් සහභාගී වූහ. එමෙන්ම NCASL හි ගරු සභාපතිතුමා, ගරු පළවන උප සභාපති, ශාඛා සභාපතිවරු සහ විධායක නිලධාරිනියද එම රැස්වීමට සහභාගී වූහ.* - _ටෙන්ඩර් මිලගණන් සහ ඉංජිනේරු ඇස්තමේන්තු සැකසීමේදී සමාජ ආරක්ෂණ දායකත්ව බද්ද (SSCL) සලකා බැලීම_ ටෙන්ඩර් මිලගණන් සහ ඉංජිනේරු ඇස්තමේන්තු සකස් කිරීමේදී සමාජ ආරක්ෂණ දායකත්ව බද්ද (SSCL) භාවිතය පිළිබඳව විස්තරාත්මකව සාකච්ඡා කරන ලදී. රාජ්‍ය ඉදිකිරීම් කාර්යයන් සඳහා පනවා ඇති බදු හා Levy කොන්ත්‍රාත්කරුවන්ට ප්‍රතිපූරණය කිරීමේ වැදගත්කම අමාත්‍යාංශ ලේකම්වරයා අවධාරණය කළේය. කෙසේ වෙතත්, ගොඩනැගිලි දෙපාර්තමේන්තුවේ මිල ලැයිස්තුව (BSR) තුළ SSCL දැනටමත් ඇතුළත් වී ඇති බැවින් සහ 2026 ජනවාරි 12 දිනැති කැබිනට් තීරණය අනුව සියලුම රජයේ ආයතනවලට ඉංජිනේරු ඇස්තමේන්තු සඳහා ගොඩනැගිලි දෙපාර්තමේන්තුවේ මිල ලැයිස්තුව (BSR) භාවිතා කිරීමට උපදෙස් දී ඇති බැවින්, පළාත් සභා එම අනුව ක්‍රියා කරමින් තමන්ගේ මිල ලැයිස්තු (BSR) තුළ SSCL ඇතුළත් කර ගත හැකි බවට එකඟ විය. -_පොදු ගොඩනැගිලි මිල නියමයන් (norms) සැකසීම_ NCASL ගරු සභාපතිතුමා වර්තමානයේ ඉදිකිරීම් කර්මාන්තය අනුකුල කරගෙන ඇති නවීන ඉදිකිරීම් තාක්ෂණ හා ක්‍රමවේදයන් සැලකිල්ලට ගනිමින් රට පුරා යාවත්කාලීන හා එකසමාන මිල නියමයන් (norms) සකස් කිරීමේ අවශ්‍යතාවය අවධාරණය කළේය. තවද, විවිධ රාජ්‍ය ආයතන විසින් භාවිතා කරන පවතින මිල නියමයන් යාවත්කාලීන නොවූ හා එකිනෙකට වෙනස් බවත්, පළාත් අතර එකම වැඩ සඳහා වෙනස් නියමයන් භාවිතා කිරීම නිසා ප්‍රසම්පාදන ක්‍රියාවලියේ අසමතුලිතතා ඇතිවන බවත් සටහන් විය. ඒ අනුව, පරණ මිල නියමයන් හඳුනාගෙන, ක්‍රමවත් සමාලෝචන ක්‍රියාවලියක් හරහා යාවත්කාලීන කරමින් රට පුරා සම්මත නියමයන් සකස් කිරීම ආරම්භ කිරීමට තීරණය කරන ලදී. යාවත්කාලීන කළ යුතු මිල නියමයන් සඳහන් කරමින් යෝජනා ඉදිරිපත් කරන ලෙස NCASL වෙත ද ආරාධනා කරන ලදී. -_පොදු කාර්යය පිරිවැය (Overhead) හා ලාභය (Profit)_ NCASL ගරු සභාපතිතුමා වත්මන් බදු ප්‍රතිපත්ති හේතුවෙන් කොන්ත්‍රාත්කරුවන්ගේ ලාභ මත බදු බර ඉහළ යාම සැලකිල්ලට ගනිමින්, පවතින මිල ගණනය කිරීමේ ආකෘතිය සංශෝධනය කළ යුතු බව අවධාරණය කළේය. ඔහු පහත ආකෘතිය යෝජනා කළේය: ඒකක මිල = පිරිවැය + 2.5% (SSCL) + 20% (පොදු කාර්යය පිරිවැය හා ලාභය ) + ව්‍යාපෘතියට අදාළ වන අයිතම ඇතුළත් කරමින් CIDA/ID/04 අනුව පිළියෙළ කල පූර්ව කටයුතු සඳහා වන බිල්පතක් (Rate = Cost + 2.5% (SSCL) + 20% (Profit and Head Office Overhead) + Separate preliminary Bill as indicated in CIDA/ID/04, including relevant items for the particular project) මෙම කරුණ තවදුරටත් සලකා බැලීමට එකඟ විය. -_*අනෙකුත් කරුණු*_ NCASL හි සභාපතිවරයා රජයේ ආයතනවල, විශේෂයෙන්ම පළාත් සභා මට්ටමින්, නිරීක්ෂණය වූ කාර්යපටිපාටි කිහිපයක් පිළිබඳවද අවධානය යොමු කළේය. ඒවා අතර: -අවම මිල ඉදිරිපත් කළ ලංසුකරු සමඟ මිල වට්ටම් සඳහා සාකච්ඡා කිරීම, -මාස තුනකට වඩා දිගු කොන්ත්‍රාත් සඳහා මිල සංශෝධන (price escalation) ලබා නොදීම, -පවතින ඉන්ධන හා අනෙකුත් ඉදිකිරීම් ද්‍රව්‍යවල මිල වේගයෙන් වෙනස් වීම සැලකිල්ලට ගනිමින් මාස තුනකට අඩු කොන්ත්‍රාත් සඳහාද මිල සංශෝධනය යෙදීමේ වැදගත්කම අමාත්‍යාංශ ලේකම්වරයා සහ අනෙකුත් නිලධාරීන් පැහැදිලි කළේ, මෙවැනි ක්‍රියා පටිපාටි ස්ථාපිත ප්‍රසම්පාදන මාර්ගෝපදේශ වලට නොගැළපෙන බවයි. පවතින නීති හා ක්‍රමවේද පිළිපැදීම මඟින් මෙම ගැටලු වැළැක්විය හැකි අතර, රාජ්‍ය ප්‍රසම්පාදන ක්‍රියාවලියේ කාර්යක්ෂමතාවය හා පැහැදිලිත්වය වර්ධනය කළ හැකි බවද ඔවුන් අවධාරණය කළහ. ප්‍රසම්පාදන මාර්ගෝපදේශ හා අත්පොත් පිළිපැදීමේ වැදගත්කම දැඩි ලෙස නැවත අවධාරණය කරන ලදී.

In response to the requests made by the NCASL, until the proposed revised Gazette on the Registration of Contractors is formally published, the Ministry of Housing, Construction and Water Supply has directed that interim Directive be issued revising the existing criteria applicable to construction contractors with immediate effect.

NCASL විසින් කරන ලද ඉල්ලීම සලකා බැලීමෙන් අනතුරුව, කොන්ත්‍රාත්කරුවන් ලියාපදිංචිය සම්බන්ධයෙන් යෝජිත සංශෝධිත ගැසට් නිවේදනය නිල වශයෙන් ප්‍රකාශයට පත් කරන තුරු, නිවාස, ඉදිකිරීම් හා ජල සම්පාදන අමාත්‍යාංශය විසින් දැනට පවතින කොන්ත්‍රාත්කරුවන්ට ලියාපදිංචි කිරීමේ ක්‍රියාපටිපාටිය සංශෝධනය කිරීම සඳහා වහාම බලපැවැත්වෙන පරිදි උපදෙස් (Directive) නිකුත් කිරීමට උපදෙස් ලබා දී ඇත.
